การจัดการขยะอิเล็กทรอนิกส์ในชุมชน: หลักการและแนวคิดภายใต้มาตรการ ทางกฎหมายของประเทศไทยและต่างประเทศ
Electronic Wastes Management in the Community: Principles and Concepts under Thai and Abroad Legal Measures
ปัจจุบันปัญหาขยะอิเล็กทรอนิกส์ในชุมชนเป็นปัญหาที่เกิดขึ้นมายาวนาน และทวีความรุนแรงมากขึ้นเรื่อยๆ ดังนั้นผู้วิจัยจึงสนใจที่จะศึกษามาตรการทางกฎหมายเกี่ยวกับการจัดการขยะอิเล็กทรอนิกส์ในชุมชน โดยการศึกษานี้มีวัตถุประสงค์เพื่อศึกษาหลักการ และทฤษฎีในการจัดการขยะอิเล็กทรอนิกส์ในชุมชน ศึกษาจุดเด่นจุดด้อยในมาตรการทางกฎหมายของประเทศไทยและต่างประเทศ และพิจารณาปัญหาหรืออุปสรรคในการบังคับใช้กฎหมาย รวมถึงเสนอแนะวิธีการทางวิชาการในการปรับปรุง พัฒนา และแก้ไขกฎหมายของประเทศไทยเพื่อให้เกิดประสิทธิภาพในการบังคับใช้กฎหมายมากขึ้น ผลการศึกษาพบว่ากฎหมายที่เกี่ยวข้องไม่มีการใช้หลักผู้ก่อมลพิษเป็นผู้จ่าย (Polluters Pay Principle: PPP) ที่ให้บริษัทฯ ผู้ผลิตต้องเข้ามามีความรับผิดชอบในส่วนของค่าใช้จ่ายในการกำจัด ไม่มีการใช้หลักการขยายความรับผิดชอบแก่ผู้ผลิต (Extended Producer Responsibility: EPR) ที่เพิ่มขอบเขตความรับผิดชอบของผู้ผลิตให้ครอบคลุมในแต่ละช่วงของวงจรชีวิตผลิตภัณฑ์ โดยไม่มีการเรียกคืนสินค้าอิเล็กทรอนิกส์ของตนเอง และไม่มีการใช้หลักผู้ได้รับผลประโยชน์เป็นผู้จ่าย (Beneficiaries Pay Principle: BPP) ที่ให้ผู้ใช้สินค้าอิเล็กทรอนิกส์เป็นผู้จ่ายเงินค่ากำจัดด้วย และไม่มีการใช้หลักการมีส่วนร่วม (Public Participation) ที่ให้ผู้ใช้ ผู้ผลิต ตัวแทนผู้จัดจำหน่าย และหน่วยงานราชการ ให้มีส่วนร่วมในการกำจัดขยะอิเล็กทรอนิกส์ ตั้งแต่การผลิต การใช้จนกระทั่งการกำจัด สิ่งที่ขาดเหล่านี้ทำให้ปัญหาขยะอิเล็กทรอนิกส์ยังคงมีอยู่ในชุมชนและมีแนวโน้มจะสูงขึ้นเรื่อยๆ การศึกษานี้มีข้อเสนอแนะว่าควรตรากฎหมายเฉพาะในเรื่องการจัดการขยะอิเล็กทรอนิกส์ในชุมชน โดยอาศัยหลักการและแนวคิดที่กล่าวมาข้างต้น เช่น การให้บริษัทฯ ผู้ผลิตรับผิดชอบค่าใช้จ่ายในการกำจัด การเพิ่มขอบเขตความรับผิดชอบของผู้ผลิตให้ครอบคลุมในแต่ละช่วงของวงจรชีวิตผลิตภัณฑ์ การเรียกคืนสินค้าอิเล็กทรอนิกส์ของตนเอง กำหนดให้ผู้ใช้สินค้าอิเล็กทรอนิกส์เป็นผู้จ่ายเงินค่ากำจัด และกำหนดหน้าที่ของทุกภาคส่วนที่เกี่ยวข้องมีส่วนร่วมในการแก้ไขปัญหาขยะอิเล็กทรอนิกส์ในชุมชน คำสำคัญ: ขยะอิเล็กทรอนิกส์ในชุมชน, หลักผู้ก่อมลพิษเป็นผู้จ่าย, หลักความรับผิดที่เพิ่มขึ้นของผู้ผลิต, หลักผู้ได้รับผลประโยชน์เป็นผู้จ่าย และหลักการมีส่วนร่วม
The problem of e-waste in the community has been now a problem for a long time and it has also become severer. This researcher is interested in the legal measures on the management of e-waste in the community with the objectives of exploring and examining key principles of and theories on e-waste management in the community in order to find out the strengths and weaknesses of those legal measures, both Thai and abroad contexts. Moreover, problems or obstacles deriving from law enforcement will be taken into the consideration of this research to recommend technical methods to improve, develop and amend those legal measures in strengthening the law enforcement. This research found that the Polluters Pay Principle is not applied to design the law which does not require manufacturing companies to take their responsibility for disposal costs. The Extended Producer Responsibility Principle is not also applied to extend the scope of manufacturers’ responsibility to cover each product lifecycle’s stage due to the lack of recalling their own electronic products and there is no use of the Beneficiary Principle which allows the users of electronic products to pay for disposal. The principle of participation which commonly allows users, manufacturers, distributors and government agencies to join together in the disposal of electronic waste is not found in the legal measures. These shortcomings provoke problems of e-waste in the community and probably become increasing. According to the problems, it is recommended that Thailand should enact specific laws on the management of electronic waste in the community based on those principles as mentioned above such as the manufacturers’ responsibility for the disposal cost, the expansion of scope of producer’s responsibility’s to each product lifecycle’s stage, the restoration of their own electronic products, the user’s payment for disposal fee, and integration among relevant stakeholders to address the problem of e-waste in the community.
